Legal experience:

Norman qualified as a solicitor in 1996 having trained with practices in the City and West End of London.  He has extensive experience of a broad range of litigation topics acquired from having worked in the City for 10 years, as well as several practices in Hertfordshire, Cambridgeshire, and Bedfordshire.  Norman is also a Chartered Fellow of the Chartered Institute of Personnel Development having gained 8 years’ experience in human resources management roles in the public sector.

Norman can provide advice and representation (including advocacy) in a diverse range of disputes having experience in the following:

  • Sale and supply of goods and services, title/conversion of goods, bailment, consumer credit, and recovery of possession of goods under Section 1 of the Police (Property) Act 1897 – particularly in the retail motor trade – and construction
  • Professional negligence and misconduct
  • Property including boundary disputes and party wall issues, commercial lease termination and renewal, rent/service charge arrears and dilapidations, possession actions, covenant enforcement including injunctive relief, leasehold enfranchisement, residential landlord and tenant, Trust of Land and Appointment of Trustees (‘TOLATA’), and an appeal under Section 217 of the Town and Country Planning Act 1990
  • Contentious probate including disputed Wills, Inheritance Act claims, removal and substitution of trustees, and Court of Protection (including Deputyship and Statutory Wills)
  • Commercial debt/asset recovery, insolvency and enforcement including orders for sale
  • Shareholder and partnership disputes
  • Defamation/malicious falsehood

Norman is proud to serve one of the largest retail motor groups in the UK.  Generally, this embraces the defence of more complex, higher value consumer claims and occasionally disputes of a more novel nature.  With almost 20 years’ experience in this field, he has become somewhat a consumer specialist.

Examples of cases that Norman has managed

Norman’s major success story was representing the winning Defendants in the High Court (Kingsley v Kingsley [2019] EWHC 1073) and the Court of Appeal (Kingsley v Kingsley [2020] EWCA Civ 297 (Ch)) in a case which concerned the scope and extent of the Court’s powers under Sections 14 and 15 of TOLATA in the context of the dissolution of a farming partnership following the death of one of the partners and in relation to land worth approximately £3.25m.

Other notable cases:

  • Reynolds v Reynolds [2005] EWHC 6 – Acted for the Claimant in a successful challenge to the validity of a Will in which it was found that the Defendant failed to discharge the burden, cast upon him due to suspicious circumstances, of proving the Testatrix knew and approved of its contents
  • Re:  KJP  [2016] EWCOP  6 – Successfully opposed an application for permission to appeal an order affirming a District Judge’s decision to direct the Public Guardian to cancel registration of an EPA after the attorneys’ objections had been struck out for failure to comply with an unless order

In addition, drawing upon his practical knowledge of human resources management and following postgraduate qualification, Norman has maintained a side specialism in employment law.

He has experience of dealing with disputes (including the conduct of Employment Tribunal proceedings) concerning unfair/wrongful dismissal, breach of contract (including restrictive covenants), unlawful deduction from wages/national minimum wage, breach of the Working Time Regulations, public interest disclosure, and discrimination.

Norman regularly advises upon settlement agreements including, when necessary, negotiation of terms.  He is also able to assist in respect of disciplinary and grievance proceedings, TUPE due diligence and issues arising from business acquisition, drafting contracts, and the provision of ad hoc general advice.
