Securing a stable and positive future for your children is the most important consideration after a separation or divorce. Our specialist solicitors provide the guidance you need to make informed decisions on your child arrangements.

We understand this is a sensitive time, and our priority is to listen to your situation, help you understand your rights and responsibilities, and find a workable solution that puts your children first.

What we do – child arrangements services

We will work with you to find a fair solution, and the best outcome for your children. The end goal is to create a framework for a stable co-parenting relationship.

Our child arrangement services include:

Child Arrangements Orders

A legally binding court order that sets out where a child will live and how much time they will spend with each parent. If you already have a child arrangements order in place and issues are arising, we can assist you with enforcing the terms or seeking to vary the agreement to reflect your current circumstances.

Specific Issue Orders

A Specific Issue Order addresses a particular aspect of a child’s life, such as their education, medical treatment, or religious upbringing. We can help you apply for a Specific Issue Order if you and the other parent disagree on a specific issue.

Prohibited Steps Orders

A Prohibited Steps Order prevents a parent from taking certain actions without the other parent’s consent. This could include changing a child’s name, moving them to a different school, or taking them out of the country. We can advise you on whether a Prohibited Steps Order is appropriate in your situation.

Parental Responsibility Orders

Parental responsibility gives a parent the legal rights and responsibilities to make important decisions about their child’s life. Mothers automatically have parental responsibility. Fathers usually acquire it if they are married to the mother at the time of the child’s birth, are named on the birth certificate (for births after 2003), or through a Parental Responsibility Order. We can assist with applications for Parental Responsibility Orders.

Leave to Remove Applications

If you wish to move your child to live outside of England and Wales or wish to relocate within the UK, you will usually need the other parent’s consent. If consent is not given, you will need to apply to the court for “leave to remove.” These applications are complex and require careful consideration of the child’s welfare. We can provide expert guidance throughout this process.

Enforcement of Child Arrangement Orders

If a Child Arrangements Order is being breached, we can advise you on the legal options available to enforce the order.

Grandparent Rights

We advise grandparents on their rights to seek contact with their grandchildren.

Our approach – working towards an amicable solution

Our approach is centred on the simple principle of putting your children’s welfare first. We focus on finding an agreement outside of court whenever possible, as this often leads to the most stable and constructive solutions for your family.

To achieve this, we can guide you through different paths, such as collaborative law, where you and your solicitors work together to reach an agreement, or mediation, where a neutral third party helps facilitate discussions.

However, if an agreement isn’t possible, we can guide you through the court process and we will represent you in court.
